Terms and Conditions of Service

SMB Technology Consulting further known as “SMB” for the entirety of this document. The party contracting business with SMB is further referred to as “you” or “your”.  This is an agreement between SMB and you. It supersedes any verbal communications or published material.

Right To Refuse: SMB reserves the right to refuse to provide computer repair service for any reason.

Ownership Requirement: You must be the owner of the hardware and software that are under service.

Minimum Age: You must be 18 years or older and must be present during the entire time period remote or onsite services are provided.

Work Authorization: You request and authorize SMB and any employee, subcontractor or consultant of SMB to examine, modify and attempt to repair any and all problems found with the computer system, data storage device, ALL files, and any peripherals left by you on the premises of the SMB. You understand an estimate fee may apply if you decline to purchase replacement parts required to complete the repair.

You authorize SMB to replace or modify any internet security software with freely available alternatives and to install an alternative web browser to protect the computer from internet threats at SMB’s discretion and without prior notification.

Indemnification: You agree NOT to hold SMB or any employee, subcontractor or consultant of SMB responsible in any way for the failure or functionality of any and all hardware or software associated with your computer, peripherals or data storage device, including any failure that occurs while attempting repair. You accept ALL RISK associated with any repair or attempted repair or any other action by SMB and its associated employees and subcontractors on any and all of your computers connected or unconnected by networks.

Back-Up Your Data: SMB will NOT back up any data unless you specifically request to do so prior to the performance of any service. You assume full responsibility to back up all of the data, information, software, or files stored on your computer product, prior to requesting service from SMB.

Warranty: SMB guarantees computer repair labor services provided for thirty (30) days. If there is an issue related to the original problem and if you notify SMB at 202-596-7255 within the 30-day time period, SMB will work to correct the problem and at no additional cost. Services rendered by SMB may void the manufacturer warranties for a product. SMB does not assume any liability or warranty in the event that the manufacturer warranties are voided. Hardware warranty is only provided by the manufacturer directly.

Limitation Of Remedy: To the extent permitted by law, you agree that SMB’s total liability for damages related to its services is limited to the total amount you pay for the services, and you release SMB from liability for any direct, indirect, incidental, special, consequential, or punitive damages. SMB IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA OR LOSS OF ANY MEDIA FROM YOUR PRODUCT.

Damage Or Loss: If any damage or loss occurs with respect to your product while in SMB’s possession or control, regardless of causation or fault, you are only entitled to replacement of the product.

EULAs: For software installations, SMB may accept End User License Agreements on your behalf.

Payment: Unless prior arrangements are made, payment is due when services are rendered. SMB only accepts cash, PayPal, or credit card as payment. When ordering any non-stocked parts, a full deposit is required before the parts are ordered.

Minimum Charge: Diagnosis fee is per computer, which will be assessed if you decline repairs for any reason. The diagnosis fee is waived if the repair is performed by SMB.

Abandoned Items: You agree to pay for services rendered within thirty (30) days of service completion. If the computer is not picked up within ninety (90) days, it will be considered abandoned according to state law and will become property of SMB and be sold to recover damages and non-payment.
